Kellie informed me that the Department is more proactive towards cost recovery, and suggested that we move forward with the placement of a lien on the Exxon-Stewart Property at this time. She also indicated that it is probably not worth our while to pursue Greg Wilson for the submittal of his financial info. at this time since he is in jail. We agreed to move forward with placing a lien on the property and not pursuing Greg Wilson for his financial affidavit at this time.

Subject: Today I received a phone call from Donna Couture (Greg Wilson's sister) in response to our letter dated September 9, 2011. Ms. Couture informed me that Greg Wilson is in jail, awaiting trial that is scheduled to begin in March. She stated that she has been tasked to look into this matter on behalf of her brother. We discussed the case. Ms. Couture informed me that her father passed away last year, and that he had mentionned that the $7,500.00 CFJ payment had been made. I explained to her that the Department had closed the tanks and performed the cleanup, and that we are now seeking to recover our costs for performing all this work. She stated that her brother has no money, and asked what the Department will do under the circumstances of his incarceration. I told her that I didn't know, that I will have to consult with our case attorney, and that I will be back in touch with her. She gave me her phone number (251) 236-1455 and stated that it is best to try to get in touch with her at 3:30 in the afternoon since she is a school teacher. I said O.K. and we ended the conversation.

Description: On site with Mr. Rafael Sarmiento, Manager, for an annual compliance inspection of (3) 12,000 gallon, double wall, fiberglass USTs installed in 1991. The registration information was verified and no changes were noted. The State registration placard was current and properly posted on site. The Certificate of Financial Responsibility was not on site, but was provided through email and is current. The policy is with Nautilus Insurance Company and is running from 09/25/2019-09/25/2020 (Policy# CST2019412-13). Annual Operability Test for release detection was not provided (*). Annual Inline Leak Detection Test was not provided (*). Overfill Protection Test for overfill protection device was not provided (*). Sump Integrity Test was not provided (*). Dispenser Liner Integrity Test was not provided (*). Spill Bucket Integrity Test was not provided (*). Monthly Visual, Electronic Detection, and Monitoring Well logs are available, 36 months noted. The logs are done by Discovery Tank Testing. Operator Training Certification A/B and Cs were available for review. Electronic release detection is monitored through the Veeder Root TLS-350. All functions were normal at the time of the inspection. The liquid status report was conducted. The sensors monitor the (3) Sumps and (3) Annular spaces. No fuel alarms noted. The visual and audio alarms are working. There are a total of (8) dispensers on site. The dispenser liners were dry and the shear valves appeared to be properly braced. No dripping or leaks noted on components within the dispensers. Hoses and nozzles are intact. Fill port & vapor recovery lids were properly color-coded/labeled as per API standards. Fill port & vapor recovery watertight caps contained gaskets and had tight seals. Fill port & vapor recovery spill containment buckets were dry. All the STP sumps were dry and contain mechanical line leak detectors. No corrosion noted on STP components. The piping boots were pulled back for release detection and the sensors were correctly positioned below piping. There are a total of (10) monitoring wells on site, as per approved plans. (07/15/1999). All monitoring well concrete pads and lids were intact and properly color coded. All monitoring well watertight caps were locked or properly secured and contain gasket. All monitoring well collars/risers were at least 1 inch above the surface and the containment appears to be properly grouted. No visual evidence of free floating product or sheen observed, as well as no odors were detected during the inspection in all monitoring wells. All monitoring wells DTW/D was measured on 05/09/2017. On that date water column levels were determined adequate for release detection meeting the 3 ft requirement. The Lat/Long Coordinates have been updated on Maps Direct. A copy of the report will be submitted via email to the site representative Ms. Melissa Campos, (305-597-0249), (mcampos@ssminc.com). (*) Violation noted must be corrected within 30 days. If the deficiency is not corrected within the allotted time, the facility will be under enforcement. Enforcement will result in the issuance of a Uniform Civil Violation Notice (UCVN). 1. Provide a current and passing Release detection test. 2. Provide a current and passing Inline Leak detector test. 3. Provide a current and passing Overfill protection test. 4. Description: Met onsite with Isaac Ogoe (AET Compliance Technician) for this inspection. Double wall USTs may remain out of service for 10 years after this time period the tank needs to be returned to service or properly closed. Prior to placing the tank system back into service tank and line tightness testing will need to be performed. TANK: 20,000 gal Double Wall (DW) Jacketed Steel UST with two compartments. 15,000 gal Regular Unleaded and 5,000 gal Premium Unleaded. UST was installed October 1, 2009. UST is registered as out of service and currently does not contain fuel. Tank must either be returned to service or properly closed by May of 2026. RELEASE DETECTION: Tank IM sensor and sump sensors monitored by Veeder Root TLS-300 ATG. Monthly visual inspections of all tank equipment is conducted by AET Compliance. PIPING: Pressurized Double Wall (DW) Flexible piping with mechanical line leak detectors. SPILL CONTAINMENT: DW wall spill buckets. Spill buckets were dry at time of inspection. OVERFILL PREVENTION: Overfill shut-off valves in drop tubes. STP SUMPs: STP sumps were clean and dry at time of inspection. Sump sensors were positioned correctly. Piping test boots loosened and entry boots appeared to be in good condition. DISPENSERS: Dispenser units have been removed and dispenser sump openings have been covered with wood.

Please see the following link for access to the new Rule and Forms: https://floridadep.gov/waste/permitting-compliance-assistance/content/storage-tank-compliance. 6,000-gallon New/Lube Oil Tank – DEP #9R1 Release Detection: - Visual inspection of tank system and components including the dispensing system (pump and nozzles/hoses); Tank/Piping: (1) 6,000-gallon, single-walled, steel AST containing New/Lube Oil. AST is located inside a sealed, concrete block secondary containment; however, as the tank contains New/Lube Oil, it is therefore exempt from the secondary containment requirement. AST is equipped with: - Product label; label is starting to fade, recommend replacing soon. - Normal and emergency vents; - Tank exterior coating appears to be in good condition; - Secondary containment – sealed, concrete block containment; - Containment was clean and dry (minor rain water) with the drain valve in the closed position at time of inspection; - Top mounted fill (locked); - Overfill protection – Secondary containment; Morrison clock gauge acts as fuel indicator. - Aboveground, supply and return lines to and from the dispensing nozzles are a combination of coated, single-walled, steel piping and flexible synthetic hoses; - Supply line is equipped with an anti-siphon valve located at the top of the tank at point of exit, upstream of a manual isolation valve; - Per the revised rule 62-762.501(3)(d)3, Florida Administrative Code (F.A.C.), Antisiphon valves. For storage tank systems that produce a gravity head on small diameter integral piping positioned below the product level in the tank, anti-siphon valves shall be installed and maintained in accordance with Section 7 of PEI/RP200-13, 2013 Edition, and Section 11.2 of NFPA 30A, Marine Fueling, Storage, 2015 Edition. For such storage tank systems installed prior to January 11, 2017, anti-siphon valves shall be installed within one year of January 11, 2017. - However, storage tank systems installed prior to January 11, 2017 that have serviceable block valves and anti-siphon valves installed with the anti-siphon valve upstream of the block valve, may continue to be operated until repairs to either valves or associated piping is necessary; at which time the valves must be installed in the correct order. - Electrical grounding wire not present; recommend installing electrical grounding wire. - No obvious signs of leakage noted. 25,000-gallon Vehicular Diesel Tank – DEP #19 Release Detection: - Visual inspection of the tank system and components including the dispensing systems (meters, pumps, and nozzles/hoses); - Electronic monitoring of tank interstice; - Veeder-Root TLS 350 alarm panel checked – L:1 sensor in alarm; - Test button pushed - visual and audible alarms functional; - Veeder-Root TLS 350 alarm panel monitors the electronic sensor located in the interstice of the AST. - Tank interstitial alarm history report on file; the electronic sensor alarms do not correspond to the most recent testing. The Veeder-Root system was in alarm at time of the inspection. Per the Veeder-Root, the L1 sensor indicates there is fluid in the tank interstice. Complete the enclosed Incident Notification Form (INF) for the alarm and investigate the cause of the alarms, then send a copy of the INF to the Department along with the investigation results. Tank/Piping: (1) 25,000-gallon, Modern Welding, double-walled, steel AST containing diesel for vehicular fueling. AST is located on a concrete pad and is equipped with: - Product label; - Normal and emergency vents (including an emergency vent for the tank interstice); - Tank exterior coating appears to be in good condition; - Remote fill port located inside a Morrison Brothers spill containment box (locked) on the south end of the tank; - Spill containment box was clean and dry, with the drain valve in the closed position at time of inspection; - Overfill protection – Morrison Clock fuel level site gauge with an audible alarm; - Audible alarm test button pushed – functioned properly; - Fill piping is aboveground, single-walled, coated, steel; - Supply piping is aboveground, single-walled, coated, steel and equipped with solenoid anti-siphon valves immediately after the (2) top mounted STPs, and upstream of the manual isolation valves; - Per the revised rule 62-762.501(3)(d)3, Florida Administrative Code (F.A.C.), Antisiphon valves. TANK 2: Premium Unleaded, 10,000 gal Double Wall (DW) Steel UST (Act 100). Both USTs were installed in May 1997. RELEASE DETECTION: Tank IM sensors are monitored by a Veeder Root TLS-350 ATG. Sensor status was normal at time of inspection. A monthly visual inspection of all tank equipment is conducted by AET Compliance. Liquid sensor status tape printed monthly. PIPING: Pressurized DW Flexible piping with mechanical line leak detectors. Line leak detectors tested by Clemens on 12/17/17 (passed). STP SUMPS: Premium STP Sump mostly clean and dry. Regular STP Sump mostly clean and dry. NOTE: It appears that both STP sumps frequently get dirt/mud inside them. Possibly due to the plastic STP lids not seating fully/properly. The plastic lid for the Premium STP sump is extremely damaged and must be replaced as soon as possible. SPILL CONTAINMENT: Both the Regular and Premium Spill Buckets were mostly clean and dry at time of inspection. Coaxial drop tubes (no vapor recovery valves). DISPENSERS: Dispenser sumps were mostly clean and dry at time of inspection. The product entry boots and electrical conduit boots in all the dispenser sumps appeared to be in good condition with no visible cracks.
